Catamaran Charter Italy Terms of Service

Welcome to Catamaran Charter Italy. These Terms of Service ("Terms") form a binding agreement between you ("User" or "you") and Cusmanich d.o.o., trading as Catamaran Charter Italy. The Company is registered in Croatia and operates an online platform that connects clients with verified yacht providers in the Italy. By using our website, apps, and related services (the "Platform"), you agree to these Terms. If you do not agree, do not use the Platform.

These Terms apply to all users, including Clients who search and book charters and Yacht Providers who list boats. Our Privacy Policy and other posted policies also apply. If there is a conflict regarding your use of the Platform, these Terms govern.

Definitions

For clarity, the following capitalized terms are used throughout these Terms:

  • Platform: Our website, mobile applications, and related tools and services.
  • Catamaran Charter Italy (or we, us, Company): Cusmanich d.o.o., the operator of the Platform, trading as Catamaran Charter Italy.
  • User or you: Any person or entity using the Platform.
  • Client: A User who searches for, books, or charters a yacht.
  • Yacht Provider: An owner, charter company, or authorized agent who lists yachts on the Platform. An independent third party.
  • Listing: An online page that describes a yacht, dates, price, equipment, and special terms.
  • Booking: A reservation for a yacht that a Yacht Provider accepts and for which payment is processed.
  • Charter Contract: A separate rental agreement between the Client and the Yacht Provider, usually signed before or at check-in.
  • Services: Features we provide to enable Listings, inquiries, bookings, payments, and support.
  • Content: Text, images, reviews, messages, and other material on the Platform.

Use of the Platform and User Eligibility

By using the Platform, you agree to the following rules and confirm you meet the eligibility criteria:

  • Minimum age: You must be 18 or older and able to enter a contract.
  • Accurate information: You will provide true and current details and update them when they change.
  • Account security: You will keep your login safe and are responsible for all activity under your account. Report suspected misuse to support.
  • Legitimate use: Use the Platform only to find or offer yacht charters. Do not post false or illegal content, upload malware, scrape data, or try to avoid Platform fees by moving a Platform lead off Platform.
  • Compliance with laws: Follow all applicable laws in the charter destination (e.g., licensing, customs, marine park rules).
  • No rights abuse: Do not infringe intellectual property or privacy rights.

We may suspend accounts, remove content, or cancel bookings if these rules are broken.

Nature of Service, Intermediary Role

  • We are an intermediary: We do not own or operate the yachts. Yacht Providers are independent businesses.
  • We are not a party to the Charter Contract: That contract is solely between the Client and the Yacht Provider.
  • Verification: We may verify basic provider data, but this is not a guarantee of boat condition or performance.
  • Content source: Most Listing data comes from Yacht Providers. We do not warrant that all details are error-free.
  • No endorsement: A Listing does not equal an endorsement. Providers are responsible for legal compliance and safety.
  • Payments: We facilitate payments for bookings but are not a bank or insurer.
  • Not a travel package organizer: We do not sell flights or hotels. Third-party add-ons are generally outside our service unless stated.

Booking Process and Confirmations

  1. Searching and inquiries: Browse the Platform and ask providers questions through the Platform.
  2. Requesting a booking: Review dates, total price, inclusions, extras, deposit, and rules before paying. Listings can be Instant Book or On Request.
  3. Payment and confirmation: Pay the required amount to submit.
    • Instant Book: Payment is processed and booking confirms at once.
    • On Request: If the provider accepts, we confirm and capture payment. If declined or expired, we release or refund any authorization.
  4. Documents and requirements: After confirmation, you must provide crew list, passport details, and skipper licenses (where required). You may also receive a provider Charter Contract to sign.
  5. Check-in and handover: Present ID and required licenses, place the security deposit, and complete a technical handover and inventory check with the base team.
  6. During the charter: Follow the permitted sailing area, safety rules, and good seamanship. Report issues to the provider promptly.
  7. Check-out and return: Return on time, refuel as agreed, and join the final inspection. Security deposits are released per provider procedure.
  8. Reviews: You may leave a review after the trip.
  9. Support: We help with Platform issues and communication. The Yacht Provider handles on-site operations.

Prices and Payment Terms

  • Pricing: Yacht Providers set rates. Listings show base price and any mandatory items. Extras may be optional or required.
  • What you may see at checkout: Charter price, Catamaran Charter Italy service fee (if applicable), included and excluded items, taxes and local charges, security deposit details, and optional extras.
  • Currency: Prices are usually shown and charged in EUR or local currency as stated. Your bank may apply conversion fees.
  • Payment methods: We use trusted payment processors. Pay only through official Platform links.
  • Payment schedule: A deposit is charged on confirmation for advanced bookings, with the balance due before embarkation. Short-notice bookings may require the full amount on confirmation. Missed balance deadlines can lead to cancellation.
  • Receipts: You receive confirmation and a receipt for processed payments from us. Providers may also issue local invoices.
  • Security: Transactions are encrypted. We never ask you to send funds to private accounts for initial booking. Report off-Platform payment requests.
  • Price errors: If an obvious pricing error occurs, we will notify you. You can accept the correct price or receive a full refund.

Cancellations and Modifications

  • Client cancellation: Follows the specific cancellation policy shown on the Listing. Any Platform fee may be non-refundable, except for provider cancellation or error.
  • Provider cancellation: You receive a full refund. We will try to help you find an alternative but are not liable for extra costs like flights or hotels.
  • Modifications: Changes require provider approval and may change the price.
  • Weather and force majeure: Delays or closures due to severe weather or extraordinary events are subject to provider terms and local law, often leading to reschedule offers or credits. Travel insurance is recommended.
  • Substitution: If your yacht is unavailable, the provider may offer a comparable or better substitute at no extra cost. If only a lower standard is available, you can receive a price reduction or a refund.

User Responsibilities

As a Client, you are responsible for:

  • Licenses and documents: Providing proof of competence (e.g., skipper license, VHF certificate) for bareboat charters, accurate crew list, and valid IDs/passports and arranging any required visas.
  • Conduct and safety: Following navigation rules, local laws, and safety instructions. No subchartering or illegal items/activities. Care for the yacht and be respectful.
  • Reporting: Telling the provider promptly about damage or mechanical issues. In an emergency, call local authorities first, then the provider.
  • Return of the yacht: Being punctual and returning the yacht in agreed condition (including refueling) and joining the check-out inspection.
  • Financial liability: The security deposit covers potential damage and often equals the insurance deductible. Gross negligence may void coverage.
  • Indemnity: You agree to hold us harmless from claims arising from your misuse or breach of these Terms.

Liability and Disclaimers

  • Intermediary role: We facilitate listings, bookings, and payments. We do not run the yachts and are not responsible for boat condition, performance, or the charter delivery.
  • Limitation of liability: We are not liable for indirect or consequential losses. Our total direct liability to you is limited to the fees you paid to us for the specific booking at issue or EUR 100 if not linked to a booking. We have no liability for injuries, illness, death, or property damage during the charter.
  • Disclaimers: The Platform and Content are provided "as is" and "as available." We do not warrant continuous service or error-free content.
  • Your indemnity: You agree to indemnify and hold us harmless from claims arising from your use of the Platform, your breach of these Terms, or your violation of third-party rights.
  • Insurance: Providers carry insurance, but we do not. We recommend travel insurance and, where useful, skipper liability or deposit insurance.

Reviews and User Content

You may post reviews and other content. Post only content you own or have rights to use. Keep it truthful, relevant, and respectful. No fake reviews, spam, or unlawful content.

  • License to us: You grant us a worldwide, royalty-free license to use, copy, modify, distribute, and display your content to operate and promote the Platform. You keep ownership of your content.
  • Moderation: We may remove content that breaks rules. We do not remove fair, honest reviews on request.

Intellectual Property

We own or license the Platform design, code, and original content. You receive a limited, revocable license to use the Platform for personal chartering needs.

  • Prohibited uses: No copying, scraping, framing, or reverse engineering. Do not reuse provider photos or text without permission.

Governing Law and Dispute Resolution

  • Governing law: Croatian law applies, without conflict rules. If you are an EU consumer, mandatory protections of your home country still apply.
  • Jurisdiction: Courts in Zagreb, Croatia, have exclusive jurisdiction unless consumer law gives you another forum.
  • Amicable resolution: Contact us first to try to resolve any issue.
  • Time limit: Claims must be filed within one year where allowed by law.

Changes to the Terms

We may update these Terms. We will post the new version with an updated date and may notify registered users. Continued use after changes means you accept the new Terms. If you do not agree, stop using the Platform.
